Terms & Conditions — YAYWIN Game Pakistan

Effective date: October 25, 2025. Please read these Terms & Conditions ("Terms") carefully. By accessing or using the YAYWIN website, mobile application, or other services (collectively "Services"), you agree to be bound by these Terms.

1. Acceptance of Terms

These Terms form a legally binding agreement between you ("User", "you", "your") and YAYWIN Pakistan ("YAYWIN", "we", "us", "our"). If you do not agree to these Terms, do not access or use the Services.

2. Eligibility

To use YAYWIN, you must be at least the minimum age required by local law in your jurisdiction. By registering, you confirm you meet the eligibility requirements and have the legal capacity to enter into this agreement. If you are registering on behalf of another person, you represent that you have the authority to do so.

3. Service Description & Skill-Based Nature

YAYWIN provides short, skill-based microgames that measure reaction, memory, precision, and logic. The outcomes of competitive gameplay depend on the user's skill and performance. YAYWIN does not offer games where outcomes are primarily determined by chance and does not operate wagering or real-money betting features as of the effective date.

4. Account Creation & Security

• Registration: You agree to provide accurate information (name, phone number or email) and to maintain the confidentiality of any account credentials or OTPs.
• OTP & Authentication: We may use one-time passwords (OTPs) for registration and login. Never reveal your OTP to others. We are not responsible for losses resulting from unauthorized access where you have shared security information.
• Account Responsibility: You are responsible for all activity conducted through your account. Notify us immediately at Contact if you suspect unauthorized access.

5. Acceptable Use & Prohibited Conduct

When using the Services, you agree not to:

• Use cheats, bots, hacks, or any modification that alters gameplay fairness.
• Attempt to manipulate leaderboards or matchmaking systems.
• Post abusive, harassing, defamatory, or illegal content in profiles or communications.
• Impersonate others or create multiple accounts to circumvent restrictions.
• Use the Services for unlawful activities, including facilitating wagers or bets.

6. Intellectual Property

All content on the Services — including game code, graphics, logos, text, and trademarks — is owned or licensed by YAYWIN or its partners. You may not reproduce, distribute, or create derivative works without prior written permission. Limited user-generated content (UGC) that you submit (profile name, avatar, public posts) is subject to our moderation and licensing as described in the Privacy Policy and these Terms.

7. Payments & Purchases (If Applicable)

As of the effective date, core gameplay is free. If any paid features, in-app purchases, or subscriptions are introduced, we will present clear pricing and refund terms. Conversion of in-app virtual items to real-world value is not supported unless expressly stated. Any paid features will be subject to this Terms section and additional terms presented at purchase.

8. Moderation, Suspension & Termination

We reserve the right, in our sole discretion, to suspend or terminate accounts for violations of these Terms, suspected fraud, abusive behavior, or other harmful activities. We may remove UGC that violates policies and cooperate with law enforcement when required.

9. Privacy

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, YAYWIN disclaims all warranties, express or implied, including fitness for a particular purpose, non-infringement, and accuracy of information.

11. Limitation of Liability

To the fullest extent permitted by applicable law, YAYWIN and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data arising from your use of the Services.

12. Indemnification

You agree to indemnify and hold YAYWIN harmless from any claims, liabilities, losses, or expenses arising out of your breach of these Terms, your misuse of the Services, or your violation of third-party rights.

13. Third-Party Links & Services

The Services may include links to third-party websites or services that we do not control. We are not responsible for these third parties' content or practices. Use third-party services in accordance with their terms.

14. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Effective date". Substantial changes will be notified through the app or by email where feasible. Continued use after updates constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Pakistan to the extent permitted by applicable law. For disputes arising from or relating to these Terms, you and YAYWIN will attempt to resolve the dispute informally first. If unresolved, disputes may be subject to the exclusive jurisdiction of the competent courts of Pakistan, unless otherwise agreed.

16. Termination & Survival

On termination of your account, certain provisions of these Terms (e.g., Intellectual Property, Limitation of Liability, Indemnification, Governing Law) will survive. Termination does not waive any rights or remedies we may have under the law.

18. Miscellaneous
